Terms of Use

1. Vegecoopia’s Mission and Roles
1.1 Based in the Royal Borough of Kingston upon Thames, we work with not only migrants but also local residents to explore green space and resources, grow our own food, and build people's sense of belonging in the community. To increase food access with a spirit of community supported agriculture, we create both physical and social spaces by developing communal gardens, providing skills training, and organising co-cooking events as well as nature crafts workshops.
1.2. There are two ways for people to enjoy Vegecoopia’s products and services:
• Anyone aged 18 or above can access our online food growing resources by registering on our platform as Members (“Members”).
• Anyone aged 18 or above can purchase food gardening services, skill workshops or cultural food events without Members registration.
1.3 To ensure the proper or improved functioning of Vegecoopia, we may carry out maintenance that can possibly restrict the availability of the website or certain features, and may also modify, enhance and introduce new services from time to time. Vegecoopia will give prior notice to Members when such changes affect Members’ contractual obligations.

2. Account Registration
2.1 You are required to register a Vegecoopia Account (“Account”) to access and use certain features of Vegecoopia, such as accessing the online food growing resources. Registration is only permitted for individuals over the age of 18. Currently, we do not accept any Account registration for legal entities, partnerships, businesses, or organisations.
2.2 You can register an Account by using an email address and creating a password. You must provide accurate and current information during registration. Vegecoopia is not responsible for the confirmation of any Member’s identity.
2.3 You shall not assign or transfer your Account to other parties. You are responsible for maintaining the confidentiality and security of your Account credentials and shall not disclose your credentials to other parties. You must immediately notify Vegecoopia if you know or have any reason to suspect that your credentials have been lost or stolen. You are responsible for activities conducted through your Account, and you must immediately notify Vegecoopia at info@vegecoopia.com if there is any known or suspected unauthorised use of your Account.

3. Vegecoopia and Members’ Content
3.1 Vegecoopia enables Members to access and view any content that Vegecoopia itself makes available on or through Vegecoopia (“Vegecoopia Content”), including proprietary Vegecoopia Content and any authorised content from third parties. Examples of the content are the educational videos and reference articles about food growing.
3.2 Vegecoopia may contain links to third-party websites, services or resources (“Third-Party Services”). Such Third-Party Services may be subject to different terms and conditions and privacy practices. Vegecoopia is not responsible or liable for any aspect of such Third-Party Services, and links to such Third-Party Services are not an endorsement by Vegecoopia.
3.3 The content made available on Vegecoopia is solely for your personal and non-commercial use. You acknowledge and agree that Vegecoopia Content, including all associated intellectual property rights, are the exclusive property of Vegecoopia and/or its licensors or authorising third-parties. You shall not remove, alter or obscure any copyrights, trademarks, service marks, logos, trade names or other proprietary rights notices incorporated in or accompanying Vegecoopia Content. You shall not use, copy, adapt, modify, prepare derivative works of, distribute, licence, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit Vegecoopia Content, except to the extent you are the legal owner of certain content or as expressly permitted in these Terms (“Terms”).
3.4 For the content Members provided (“Member Content”), unless Members provide written consent, Vegecoopia does not claim any ownership rights in any Member Content and nothing in these Terms will be deemed to restrict any rights that you may have in using your Member Content. Vegecoopia respects copyright law and expects its Members to do the same. If any content on Vegecoopia infringes the copyrights you own, please notify us immediately.
3.5 You are responsible for all Member Content that you make available on or through Vegecoopia. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of your Member Content or you have all rights, licences, consents and releases that are necessary to grant to Vegecoopia the rights in and to such Member Content, as contemplated under these Terms; and (ii) neither the Member Content nor Vegecoopia’s use of the Member Content (or any portion thereof) as contemplated under these Terms will infringe, misappropriate or violate a third party’s patents, trademarks, copyrights, trade secrets, moral rights or other proprietary or intellectual property rights, or privacy and publicity rights, or result in the violation of any applicable law or regulation.
3.6 You shall not post, upload, publish, submit or transmit any Member Content that: (i) is fraudulent, false, misleading (directly or by omission or failure to update information) or deceptive; (ii) is defamatory, libellous, obscene, pornographic, vulgar or offensive; (iii) is violent or threatening or promotes violence or actions that are threatening to any other person or animal; (iv) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (v) promotes illegal or harmful activities or substances; (vi) explicitly attempts to use the services provided by Vegecoopia for any purpose other than seeking assistance in food growing; or (vii) violates Vegecoopia’s Terms or policies.
3.7 You shall not copy, store or otherwise access or use any information, including personally identifiable information about any other Members, contained on Vegecoopia in any way that is inconsistent with Vegecoopia’s Privacy Policy or these Terms or that otherwise violates the privacy rights of Members or third parties.
3.8 Members acknowledge that Vegecoopia has no general obligation to monitor Member Content, but has the right to review, remove or disable access to, or edit any Member Content, in order to (i) operate, secure and improve Vegecoopia (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) respond to Member Content that we determine is harmful or objectionable; or (v) take actions set out in these Terms. Vegecoopia may notify a Member when we remove or disable such inappropriate Member Content, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iiI) contravene applicable laws. The Member can appeal such a decision by contacting Vegecoopia at info@vegecoopia.com .

4. Membership Fee
4.1 Currently, there is no Membership Fee (“Membership Fee”).
4.2 Vegecoopia reserves the right to change the Membership Fee at any time, and will give Members prior notice of any fee changes before they become effective. Such fee changes will not affect any transaction made prior to the effective date of the fee changes.

5. Nondiscrimination and Safeguarding
5.1 Inclusion and respect are the core values of Vegecoopia’s advocacy of community supported agriculture. Your use of Vegecoopia and your participation in the food growing shall not and shall not assist or enable others to (i) discriminate against or harass anyone on the basis of race, ethnicity, national origin, religion, sexual orientation, gender, gender identity, medical condition, physical or mental disability, age, marital status, or occupation, and (ii) violate or infringe anyone else’s rights or otherwise cause harm to anyone.
5.2 Vegecoopia’s members of staff and associated personnel are trained to design and undertake all the programmes and operations following our own Equality, Diversity and Inclusion Policy and Safeguarding Policy.

6. Disputes between Members
6.1 While we work hard to ensure our Members have great experience using Vegecoopia, we have no control over the conduct or performance of our Members, and do not guarantee the truth or accuracy of any Member Content (as defined in section 3). Vegecoopia does not endorse any Members and third parties. You shall always exercise due diligence and care when communicating and interacting with other Members, both online or in person.
6.2 When disputes arise in connection with any complaints made by Members, Members shall cooperate with and assist Vegeoopia in good faith, to provide Vegecoopia with such information and take such actions as may be reasonably requested by Vegecoopia. A Member shall, upon Vegecoopia’s reasonable request and at no cost to the Member, participate in mediation or a similar resolution process with another Member. Members are entitled to terminate their participation in the mediation or similar resolution process at any time, their right to take legal action before a court of law remains unaffected.
6.3 If you feel that any Member you interact with, whether online or in person, is acting or has acted inappropriately, including but not limited to anyone who (i) performs offensive, violent or sexually inappropriate behaviour, or (ii) engages in any other disturbing conduct, you shall report the person to the appropriate authorities immediately.

7. Membership Cancellation
7.1 You may cancel your Membership at any time as you wish, by contacting Vegecoopia at info@vegecoopia.com .
7.2 If Vegeoopia notices that there will be (i) fraud or other illegal activities, (ii) harm to the legitimate interests of other Members or third parties, or (iii) contravention of applicable laws in Member Content or the food growing activity, Vegecoopia can cancel a Membership and notify the Member about the situation.
7.3 In addition, Vegecoopia may take any of the following measures (i) to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, or if (ii) you have breached these Terms or our policies, applicable laws, regulations, or third party rights, (iii) you have provided incomplete, inaccurate or fraudulent information in Vegecoopia’s Account registration or thereafter, (iv) Vegecoopia becomes aware of or has received complaints about your performance or conduct, or (v) such action is necessary to protect the personal safety or property of Vegecoopia, its Members, or third parties, or to prevent fraud or other illegal activities:
• To suspend or limit your access to or use of Vegecoopia and/or your Account; or
• To suspend or remove your Member Content

8. General Provisions and Terms Termination
8.1 These Terms constitute the entire Agreement (“Agreement”) between Vegecoopia and you pertaining to the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Vegecoopia and you in relation to the access to and use of Vegecoopia.
8.2 This Agreement shall be effective until either you or Vegecoopia terminate the agreement in accordance with these Terms. You may terminate this Agreement at any time by sending us an email.
8.3 The access to or use of the features of Vegecoopia may be subject to separate policies, standards or guidelines, or may require that you accept additional terms and conditions, before you can access the relevant features of Vegecoopia. If there is a conflict between these Terms and the terms and conditions applicable to a feature of Vegecoopia, the latter terms and conditions will take precedence with respect to your access to or use of that feature, unless specified otherwise in the latter terms and conditions.
8.4 Vegecoopia reserves the right to modify these Terms at any time in accordance with this provision. When we make modifications to these Terms, we will provide you with 30 days’ notice by email. Such notice will also inform you about your right to reject the proposed changes, the timeframe to do so, and your right to terminate the Agreement at any time before the effective date of the proposed changes as provided in these Terms. If you do not terminate the Agreement before the date the revised Terms become effective, your continued access to or use of Vegecoopia will constitute acceptance of the revised Terms.
8.5 Vegecoopia may immediately, without notice, terminate this Agreement and/or stop providing access to or use of Vegecoopia if (i) you have materially breached your obligations under these Terms or our policies, (ii) you have violated applicable laws, regulations or third party rights, or (iii) such action is necessary to protect the personal safety or property of Vegecoopia, its Members, or third parties.
8.6 When this Agreement has been terminated, you are not entitled to a restoration of your Account or any of your Member Content. If your access to or use of Vegecoopia has been limited, or your Account has been suspended, or this Agreement has been terminated by Vegecoopia, you may not register a new Account or access and use Vegecoopia through an Account of another Member.
8.7 If Vegecoopia takes any of the measures described above, you may appeal such a decision by contacting us at info@vegecoopia.com .

9. Feedback
Being engaging and reflective are also the core values of Vegecoopia. You are welcome to provide any feedback, comments and suggestions for improvement to Vegecoopia.
